Videography Standard Terms and Conditions
This
contract is between the Bride and Groom named above (the “Customer”)
and Curious Weddings Ltd (the “Company”). Product
or Service shall mean any product or service that is provided
by the Company to the Customer. The Booking Form plus the terms
and conditions form the basis of your contract with us.
In
consideration of the fee paid, The Company agrees to supply
the Product(s) or Service(s) to the Customer as detailed in
the Booking Form and according to the terms and conditions of
this contract. The fee is for agreed Products and/or Services
plus any additional travel expenses on your Wedding day and
includes 3 copies of your wedding film on DVD (in PAL format).
Should
the Company choose not to enforce any or all of these conditions
it should not be interpreted as a waiver of any of the Company’s
rights. By providing the Company with an Order, the Customer
accepts these terms and conditions.
Deposit
All weddings require a non-refundable deposit of £250
to secure the booking.
Final
Payment
The final balance for the Wedding Filming must be paid no later
than three weeks before the event date. Final balances for any
filming or other services provided before the Wedding date are
due upon completion of these services. If payments are not received
by the due date, the Company reserves the right to cancel any
booking made with us and/or to withhold all goods until full
payment is made. We accept the following means of payment:
• Cheque made payable to Curious Weddings Ltd
• Direct bank transfer
Cancellation
/ Refund Policy
All booking deposits are non-refundable, regardless of the circumstance
of any cancellation by the customer. If the wedding is cancelled
at any time prior to the appointed date, and the customer has
paid in full, a refund of the total amount less the deposit
will be offered. If the wedding is cancelled on the day, and
the Company is already on site, a refund of up to 50% of the
total package price will be offered. Following completion of
the wedding filming, no refund will be offered.
Filming
Schedule
Filming will start a minimum of 1 hour before the ceremony unless
otherwise agreed. Filming will stop at the pre-agreed finishing
time. In the event that celebrations on the day run late, howsoever
caused, we will attend until up to 30 minutes after the agreed
finishing time, free of charge. After this time, attendance
is at the videographers’ discretion and subject to the
hourly rates as advised on our pricelist, payable in advance
on the day.
For the purposes of clarification, we do not film continuously
during the day. As such, we ask for a detailed running order
in advance, and to be kept abreast of unfolding events on the
day.
We
would be grateful if you could arrange some food and drink to
be provided for our videographers at the reception, as they
work a long day.
Camera
Positions & Filming Conditions
The Company will make every effort to use the best position
for the cameras to film the event however, due to restrictions
imposed upon the Company on the day, this may not always be
possible. The Customer understands and accepts that the video
coverage will be as determined by the videographer’s professional
expertise and that no one shot or scene will be deemed more
important than another. Special requests from the Customer are
not binding instructions, although every effort is made to comply
with the Customer’s wishes.
The
Company is not responsible for camera or equipment failure for
reasons beyond our control, or for the actions of third parties
which impact our filming, for example, visual obstruction or
camera shake caused by persons. We cannot be held responsible
for any detrimental impact on the footage caused by failures
or problems with sound or lighting equipment, or the operation
thereof, where such equipment is not under our control.
We
reserve the right not to use our equipment in any situation
(for example inclement weather conditions) which may compromise
the safety of either our equipment or our videographers.
It should be noted that filming in low light situations (e.g.
small rooms, candlelight, disco/dance areas, evenings and nights
outdoors) may impact on the quality of the image captured by
the camera. In such situations, the videographers and the editor
will do their best to achieve a bright image without significant
degradation in image quality (graininess).
The Company cannot guarantee video quality in adverse lighting
or weather conditions, or in rooms generating a strong colour
tinge to the light which may not be satisfactorily correctable
during editing.
We
cannot be held responsible for any detrimental impact on the
footage caused by locations chosen by the official photographer
which may not be well suited to video. Similarly, areas chosen
for the formal parts of the day – which are outside of
the control of the videographers – may in some venues
lead to extreme backlighting or images of high shadow or contrast.
Where possible, we will minimise these impacts through our camera
positioning.
We cannot be held responsible for any detrimental impact on
the film sound caused by the refusal of any person to wear or
use a radio microphone on request, or such interferences/problems
as loud ambient noise, crying children, stray sounds on the
radio microphone caused by personal actions, echo or sound-deadening
properties of the filming location, or shutter noise from nearby
cameras.
The
Company will seek to obtain the best source footage for inclusion
in segments of the film which require the active participation
of attendees at the event, however we cannot be held responsible
for any impact on the film caused by a low level of participation.
Please note that our videographers attend in a professional
capacity and are not obliged to accede to any request to operate
cameras or camcorders belonging to any attendees.
Permission
to Video
The Customer must obtain permission to film at the appointment
location(s) from the relevant authorities, and is responsible
for any fees that may be levied by such authorities. The Company
will not be responsible for any detrimental impact on the film
caused by the refusal to allow two operated cameras to be used
at all times, regardless of the time at which such refusal comes
about.
Liability
The Company accepts no liability for any loss or damage that
may arise from the supply of the product(s) or service(s). In
the unlikely event of the Company being unable to supply the
product(s) or service(s) as specified in the Order, liability
shall be limited to the total invoice value; in the event that
the Customer has made a partial payment, to monies already paid
by the Customer.
Whilst every care is taken in the handling of the Customer’s
property, the Company accepts no responsibility whatsoever for
any loss or damage, howsoever caused, or any other loss by unforeseen
circumstances whilst they are in the custody of the Company.
Liability for such loss or damage will be limited to the replacement
cost of the materials or media and in no circumstances will
any liability attach to any claim for the value of the content.
Attendance
Whilst we shall make every effort to arrive in a timely manner,
the Company cannot be held responsible for any impact on the
videographers attendance and timeliness caused by traffic delays,
unforeseen illness or incapacity, or technical camera or sound
equipment failure. We reserve the right to change the nominated
attending videographers at any stage.
Confidentiality
Unless otherwise agreed, the Company will treat any information
gained during the supply of the product(s) or service(s) as
being private and confidential. Likewise, the Customer shall
keep confidential any methodologies and technology used by the
Company to supply the product(s) or service(s).
Copyright
Unless otherwise stated in the Order, the Company retains copyright
in all their Original Material. Original Material includes video
recordings, graphics, soundtracks, printed material and any
other design or artwork commissioned by the Customer in relation
to the Order. The Customer must ensure that permission is sought
for the inclusion of any copyright material they supply to the
Company to enable them to deliver the product(s) or service(s).
The Customer must also ensure that permission is sought for
the inclusion of any performers or performances, trademarks
and locations. The Company retains the right to use this material
in its original and edited form as they see fit, unless otherwise
agreed in the Order. The Customer agrees to indemnify the Company
in the event of any breach of copyright claims being brought
against the Company in respect of material supplied by the Customer.
Health
& Safety
The Company and Customer will act in accordance with all relevant
health and safety requirements in order to provide the product(s)
or service(s).
We
do not normally use additional mains-operated lighting, mains
power for cameras or cause trailing cables to be present, but
reserve the right to do so.
Right
of Assignment
The Company retains the right to assign the supply of the product(s)
or service(s) to the Customer to another suitable company should
it be unable to complete these terms and conditions.
Whole
Agreement
This agreement contains the entire understanding of the parties
and supersedes all prior written or verbal agreements or representations.
No variation will be binding unless in writing and signed by
an authorised representative of the Company.
Basis
of law
These Terms and Conditions and any accompanying letter and/or
contract are governed by the laws of England and Wales.
The
Finished DVD
The Company will edit your DVD to our professional standards
and shall have final editorial control on the finished product
in all cases. The length of the DVD (or 2 DVD set) will be defined
by the duration of the formal parts of your day, plus the amount
of additional footage shot.
Our
DVD is designed to be viewed by a family audience, and as such
we will not include any music containing profane, inappropriate
or controversial lyrics or themes. Additionally, we will not
include any profane language or gestures that may have been
recorded on the Wedding day. Our aim during the formal parts
of the day (ceremony, speeches) is to record and present events
as they happen. It is not usually possible to ‘fix’
any mistakes or hitches that may occur in such live and unique
occasions.
We will provide you with 3 copies of your DVD in PAL format.
Further copies of the DVD or further additional services may
be ordered separately at a later date. Our DVDs are Standard
Definition (SD). We do not support HD-DVD or Blu-Ray as yet,
due to the uncertainties of the ‘format war’ and
the minimal use of these technologies in the industry. We can
ship DVDs to anywhere in the world, and we can also provide
DVDs in NTSC format, but at additional cost due to the significant
additional editing time involved.
Images
used on your DVD sleeve are generated from the footage shot
and as such their quality is limited by the inherent resolution
used for image capture from video.
We
do not offer screenings of your film or send out proof copies
or incomplete edits for your review or approval, except in the
case of the Save The Date / Wedding Invitation service. Any
alterations to the DVD after completion are at our discretion
and may incur additional charges.
As
each DVD copy is separately licensed by us through the appropriate
authorities, any further duplication not undertaken by the Company
is a breach of licensing and copyright laws.
Any post-Wedding options will be invoiced separately as per
our pricelist. Payment for any services subsequent to your event
must be made in full upon order of such additional services.
The
DVD of your event will be ready for postage to you either within
12 weeks of your Wedding Date (unless Fast Track Service has
been requested) or within 12 weeks of your providing a music
list to us, whichever is the later. Such a timescale excludes
any unforeseen illness, incapacity or technical problems within
the Company, or force majeure events.
All
Music included on the DVD will be chosen personally by you unless
otherwise agreed. We cannot be held liable for any delays in
supplying the DVD caused by the late supply to the Company of
music or other information necessary for the production of the
DVD. In the event of delays, customers who provide music in
a timely manner will be edited in preference. If we do not receive
all such necessary instructions from you within 12 weeks of
your wedding date, completion of the DVD will only be within
the best timescale achievable.
Your
watermarked web clip will be retained on our site for a minimum
period of 12 months from the date of its completion.
Any faults with the supplied DVDs must be notified to us within
30 days of receipt. We have an exceptionally low failure rate
on DVDs but will be happy to replace any with replicable faults.
